The Firm provides counseling, representation and other legal services in construction matters, which include:

Providing pre-dispute claims avoidance and management, preliminary case analysis, expert witness evaluation, and other matters, in many cases strengthening the client's bargaining position during negotiations and achieving resolution of disputes without resorting to costly and time-consuming litigation.

Drafting and reviewing construction contracts and related contract documents such as performance, surety, guaranty and other construction-related bonds, technical specifications, plans and drawings, construction schedule in S-curve, Primavera, PERT-CPM and other generally accepted engineering scheduling systems, instructions to bidders, invitations to bid and bid bulletins.

Providing assistance to clients in negotiating and preparing construction-related claims, which include entitlement to time extensions under Primavera, PERT-CPM or other generally accepted engineering scheduling systems, additional costs, determination of design professional responsibility, construction defects, compliance with specifications and other technical requirements.

Representing clients in arbitration proceedings before the Construction Industry Arbitration Commission. Some of the more significant cases include:

  • A dispute involving claims for time extension in a hydroelectric plant construction project arising from unfavorable site conditions brought about by more than 23 kilometers of underground blasting/tunneling works; and claims for damages by reason of alleged non-compliance with technical requirements in which component parts were sourced from different manufacturers
  • A dispute involving claims for damages due to alleged non-compliance with technical specifications, additional cost of change orders and time extension in the construction of a 50-megawatt power station in Luzon Island
  • A dispute involving a claim for damages arising from delays due to alleged unfavorable site conditions, logistical constraints, improper construction methodology and poor workmanship relative to the project management and construction of twenty (20) luxury villas in an island resort located in the Visayas
  • A dispute involving a claim for financial and technical time extensions, early completion bonus, extended overhead costs and additional cost of changes in methodology arising from the construction of a podium structure that serves as train depot for a light rail transit system in Metro Manila
  • Various disputes involving claims for technical time extensions, additional cost due to changes in formwork methodology, poor workmanship and other delay-related claims arising from the construction of several high-rise luxury condominium projects in Fort Bonifacio, Taguig; Rockwell, Makati; and Salcedo Village, Makati, Metro Manila
  • A dispute arising from assailed variation orders, delay-related claims and additional costs relative to the design, engineering, construction and procurement of a major hospital in Fort Bonifacio, Taguig
  • A dispute arising from alleged poor workmanship, additional costs due to changes in the scope of work and cost due to delay-related claims relative to the construction of a construction equipment manufacturing facility located in the Cavite Export Processing Zone
  • A dispute arising from workmanship, additional costs and delay-related claims relative to the construction of the headquarters of a major television broadcasting company
  • A dispute involving a claim for the cost of rectification of alleged defects in the design and construction of a manufacturing plant located in the Southern Tagalog Region
